The Trademark Trial and Appeal Board granted Hole in 1 Drinks Inc.'s petition to cancel an individual’s registration for the mark “Hole in One” for sport performance and recovery drinks. The board found that the individual didn’t have a right to file the application due to lack of a bona fide intent to use the mark by himself. He and another individual had a bona fide intent to use the mark as joint applicants, and the trademark application should have been filed in their names as joint applicants, the board determined. The case is Hole In 1 Drinks, Inc. v. Lajtay, TTAB, Cancellation No. 92065860, 2/19/20
