A federal district court in Texas granted American Dairy Queen Corporation’s motion for partial summary judgment on its action for trademark infringement, breach of contract, declaratory judgment, and unfair competition against franchisee UAM LLC. The court determined UAM breached the franchise agreement and that no genuine dispute of material fact exists as to ADQ’s federal and state common law infringement causes of action.
