Case: Trademarks/Summary Judgment (W.D. La.)

A federal district court in Louisiana granted Southern Green Lawn Care and several individuals’ motion for summary judgment and dismissed All Green Corp.’s trademark infringement and trade secret misappropriation claims with prejudice. The court found that the unregistered mark “Green Country” wasn’t inherently distinctive and hadn’t acquired secondary meaning. And the court dismissed the trade secret misappropriation claim for failure to identify protective measures taken to secure the alleged secrets.
