The Ninth Circuit affirmed the decision of a federal district court in California granting Igloo Products Corporation summary judgment on Vericool World LLC’s action claiming Igloo falsely marketed its cooler as the first biodegradable cooler. The appeals court said that Vericool’s claim concerns the origin of an idea embodied in its coolers, rather than the characteristics of the product itself, and is not cognizable under the Lanham Act.
