Online King LLC’s motion for a temporary stay of discovery in PopSockets LLC’s action for trademark infringement, unfair competition, and false advertising, pending the resolution of Online King’s motion to dismiss for lack of personal jurisdiction or, alternatively, to transfer venue is granted. The Federal Rules of Civil Procedure don’t provide for a stay of proceedings while a motion to dismiss is pending, and a stay isn’t warranted merely because Online King filed a motion to dismiss that it believes is dispositive.
