A federal district court in New York granted in part and denied in part Parkerrose LLC and Finalee LLC’s motion to dismiss Carnegie Hospitality LLC’s action seeking declaratory relief relating to the alleged infringement of the “Carnegie” mark. According to the court, there was a live infringement controversy that could properly be the subject of a declaratory judgment action.
