The Tenth Circuit affirmed the order of a federal district court in Oklahoma granting a motion to enforce a settlement between franchisor Choice Hotels International Inc. and Papamkrupa Hospitality LLC, but vacated judgment and remanded for further proceedings. Choice terminated the franchise on the ground that Papamkrupa failed to pay fees, and then claimed that Paramkrupa infringed its trademarks. The district court granted Choice’s motion to enforce a settlement agreement and awarded $200,000 to Choice Hotels for Paramkrupa’s failure to timely pay, and Paramkrupa appealed.
