A federal district court in New York granted Mattel Inc.’s motion for statutory damages and injunctive relief and denied its motion for attorneys’ fees arising from its trademark counterfeiting claim against online sellers. The court found that the sellers willfully infringed on Mattel’s registered marks by manufacturing and selling counterfeit “Uno” cards. And the court declined to award Mattel attorneys’ fees because the sellers didn’t litigate the case in an unreasonable manner and there was no evidence that this was an exceptional case.
