The Trademark Trial and Appeal Board reversed an examining attorney’s refusal to register “Gasper Roofing,” with “Roofing” disclaimed, for roofing repair and services, based on a likelihood of confusion with “Jasper Contractors.” The board said that that the dissimilarity of the marks in sound, appearance, meaning and commercial impression is sufficiently great that, coupled with an elevated level of purchaser care, outweighs the identical nature of the services, trade channels and classes of consumers.
