A federal district court in Texas dismisses MyStore Inc.'s counterclaims in HEB Grocery Co.'s action for infringement of its “Mi Tienda” mark. MyStore claims that HEB bullied its owner and maliciously prosecuted the case, and asks the court to cancel HEB’s marks. The court finds that MyStore’s mark was canceled because he didn’t renew his registration, and that HEB did nothing to interfere with or cancel the mark. And HEB’s claims are neither frivolous or predatory, according to the court. The case is HEB Grocery Co. v. Meagher, 2019 BL 493749, S.D. Tex., No. H-17-2810, 12/26/19.
