The Federal Circuit affirmed the decision of the Trademark Trial and Appeal Board refusing an individual’s registration of two standard character marks, “All Rise,” and “Here Comes the Judge,” and one design mark, for clothing and caps. According to the court, substantial evidence supports the board’s findings that the Major League Baseball Players Association’s marks functioned as trademarks.
