The Trademark Trial and Appeal Board denied Panini America Inc.'s motion to strike RLP Ventures LLC’s trial exhibits as an estoppel sanction, in RLP’s opposition to Panini’s registration of “Mosaic” for trading cards. The board determined that RLP’s evidence was improperly filed under seal without a public version, and it struck RLP’s notice of reliance and said an amended notice of reliance must comply with the board’s applicable rules.
