A federal district court in Illinois denied Sonzea Trading Co. Ltd., Suzhou Ruoxing Network Technology Co. Ltd., Jiangxi Dengshuo Network Technology Co. Ltd., Shenzhen Jiayi E-Commerce Co. Ltd., Reyoe Technology Co. Ltd., and Zero-Miracle Network Ltd.'s motion to dismiss Margaritaville Enterprises LLC’s action for trademark infringement and counterfeiting and false designation of origin of the “It’s Five O’clock Somewhere” mark. The court said that Margaritaville plausibly alleged that the use of the mark is likely to leave consumers with the false impression that the apparel is produced or approved by Margaritaville.
