Case: Trademarks/Procedure (5th Cir.)

The Fifth Circuit affirmed in part, modified in part, and remanded in part the decision of a federal district court in Texas that BeckerTime LLC infringed Rolex Watch USA’s trademarks. The appeals court affirmed the district court’s judgment insofar as it concluded that BeckerTime infringed Rolex’s trademarks, that the laches defense prevented disgorgement of BeckerTime’s profits, and that Rolex wasn’t entitled to treble profits or attorneys’ fees. And the Fifth Circuit affirmed as modified the district court’s injunction in part and remanded in part.
