The Second Circuit affirmed the decision of a federal district court in New York dismissing Ripple Analytics Inc.'s trademark infringement and unfair competition action against People Center Inc. The appeals court determined that the district court correctly dismissed the trademark infringement claim because Ripple wasn’t the real party in interest, correctly dismissed Ripple’s unfair competition claims for failure to allege standing, and properly denied Ripple’s motion to file an amended complaint. And the Second Circuit determined that the district court’s interlocutory order granting People Center’s motion to amend its answer wasn’t properly before it on appeal.
