The First Circuit reversed and vacated in part and affirmed in part decision of the District of Puerto Rico granting the Commonwealth of Puerto Rico and several individuals’ motion to dismiss this trademark infringement action brought by the sons of late baseball player Roberto Clemente relating to the use of Clemente’s name and image on commemorative license plates and registration tags. The appeals court vacated the district court’s dismissal of the claims against the individual officials in their personal capacities, and otherwise affirmed the dismissal of the claims.
