Case: Trademarks/Pleading (M.D. Fla.)

Roor International and its exclusive U.S. licensee Sream have plausibly pleaded that Lotus Smoke Shop owner, manager, and/or operator Rahim Ali is liable for Lotus Smoke Shop’s sales of counterfeit RooR-branded glass water pipes. These allegations, if proven true, are enough to hold Ali personally liable for Lotus Smoke Shop’s infringing sales. Joint pleading is proper here as each defendant’s liability is based on a common factual scenario. The case is Roor Int’l BV v. Ali, 2019 BL 250541, M.D. Fla., 2:19-cv-62-FtM-99MRM, 7/8/19.
