The Trademark Trial and Appeal Board granted State Permits Inc.'s petition to cancel Fieldvine Inc.'s “Permits.com” marks for construction planning and zoning software, on the grounds of prior use and a likelihood of confusion with State Permits’ “Permit.com” marks for building permits. The board said that State Permits showed that it was the prior user for purposes of prevailing on its likelihood of confusion claim and its petition to cancel.
