The Trademark Trial and Appeal Board denied Keystone Consolidated Industries Inc.'s petition for cancellation of the Franklin Investment Corp.'s red, white, and blue fence post mark, based on a likelihood of confusion. The board said that Keystone didn’t show that confusion with its red top fence post mark is likely, because the marks are distinct and dissimilar.
