Case: Trademarks/Likelihood of Confusion (D.P.R.)

The district of Puerto Rico granted Solar NOW P.R. LLC’s motion to dismiss Windmar PV Energy Inc.’s trademark infringement claims on the grounds that Windmar hasn’t plausibly alleged likelihood of confusion. The court found that the logos used in Solar NOW’s advertisements didn’t closely resemble the registered marks. And the court dismissed the unfair competition and false advertising claims, as well as the dilution claims.
