The District of Colorado denied Castle Pines Golf Club Inc.’s motion for a preliminary injunction in connection with its trademark infringement counterclaim in Brinkerhoff Restaurants LLC’s action seeking a declaratory judgment of noninfringement. The court found that Castle Pines was unlikely to succeed on the merits of its counterclaim because there was little likelihood of confusion between the “Bar Hummingbird at the Brinkerhoff” and “The Hummingbird Party” marks.
