The district of Colorado denied Pretty Colorado LLC’s motion to dismiss Spice Merchants Entities Corp.’s trademark infringement claim. The court found that the Pretty Colorado was a previous franchisee that continued to sell identical products, and said that, at this stage of litigation, Spice Merchants plausibly stated a claim for consumer confusion.
