The Tenth Circuit affirmed the decision of a federal district court in Utah granting Mast-Jaegermeister US Inc. summary judgment on Alfwear Inc.'s trademark infringement and unfair competition action. The appeals court said that no reasonable juror could find a likelihood of confusion between Mast-Jaegermeister’s “Kühl” mark for alcohol and Alfwear’s “Kühl” mark for outdoor apparel and gear.
