Grote Industries Inc.'s motion to dismiss and for summary judgment, in Truck-Lite Co. LLC’s action against Grote for trademark infringement and unfair competition under federal and New York law, was denied by a federal district court in New York. The court noted that (1) each of Truck-Lite’s claims involve its penta-star pattern and either Grote’s alleged infringement of that pattern or Grote’s challenge to the registration of the pattern, and (2) Grote does not dispute personal jurisdiction with respect to Truck-Lite’s work-lamp claims, which are based on the penta-star pattern, the ‘319 application, and the ‘147 registration.
