A federal district court in New York granted Bonner & Partners LLC’s motion to dismiss for lack of personal jurisdiction Brownstone Investment Group LLC’s action for trademark infringement, trademark dilution, and unfair competition. Bonner offers financial services and publishes newsletters under various brands, including Brownstone Research, and Brownstone claimed that Bonner’s activities have caused substantial actual confusion. The court noted that the only actual New York purchase of Bonner’s products alleged by Brownstone was purchased by its paralegal, and that Browstone failed to establish that Bonner regularly does or solicits business in New York.
