The board denied the system’s motion to dismiss for lack of subject matter jurisdiction on the basis of state sovereign immunity. And the board denied the system’s motions to dismiss for failure to state a claim on the bases of likelihood of confusion, dilution by blurring, and lack of a bona fide intent to use.
