A federal district court in Indiana granted a motion to dismiss for lack of jurisdiction Zimmer Inc.'s action for trademark infringement with respect to Zimmer Medizinsysteme GmbH, but denied it with respect to Zimmer Medizinsystems Corporation. Zimmer Inc. claimed that German company Zimmer Medizinsysteme GmbH manufactured and its American distributor, Zimmer Medizinsystems Corporation, sold medical devices improperly using its trademarks. According to the court, Zimmer Medizinsystems Corporation has case-linked minimum contacts with Indiana, and personal jurisdiction over it doesn’t offend traditional notions of fair play and substantial justice.
