The Sixth Circuit reversed and remanded the decision of a federal district court in Tennessee dismissing for lack of jurisdiction AMB Media LLC’s action against Arizona companies OneMD LLC and Red Mountain Media Group LLC for trademark infringement, unfair competition, and violation of the Tennessee Consumer Protection Act, relating to AMB’s “Legacybox” service. The appeals court said that OneMD and Red Mountain hold themselves out publicly as welcoming Tennessee sales and conduct a regular course of business in the state.
