A federal district court in New York denied Equibal Inc.’s motion for a preliminary injunction in this trademark infringement, unfair competition, and false designation action against 365 Sun LLC and several individuals, relating to Equibal’s “Nufree” mark. The court said that Equibal failed to establish a likelihood of success on the merits, because it didn’t show that 365 Sun’s “Nutree” mark is likely to cause consumer confusion.
