A federal district court in Florida denied KAWS Inc.’s motion for a preliminary injunction with respect to its trademark infringement and unfair competition claims against Printify Inc., on the grounds that it was unlikely to succeed on the merits. The court found Printify didn’t design any of the infringing products and didn’t use the mark in commerce. And the court determined that Printify was unlikely to be held liable for vicarious infringement.
