A federal district court in California granted Biomax Health Products LLC’s motion for a preliminary injunction in its action against PerfectX USA for trademark infringement, unfair competition, and false advertising relating to the “Penetrex” mark for topical joint and muscle therapy cream. The court said that Biomax made a strong showing that it owns a valid, protectable mark and that there is a high likelihood of confusion between its mark and PerfectX’s “PerfectX” intensive concentrate cream.
