A federal district court in Florida denied Horseplay Inflatables LLC’s motion for a temporary restraining order and preliminary injunction enjoining an individual from using a confusingly similar trade name in violation of the Lanham Act, common law unfair competition and trademark infringement, and Florida’s Deceptive and Unfair Trade Practices Act. The court determined that Horseplay didn’t demonstrate a substantial likelihood of success on the merits or irreparable harm.
