The district of New Jersey granted Mister Softee Franchise LLC’s motion for attorneys’ fees and a permanent injunction enjoining ice cream trucks from using protected marks. The court found that the trucks’ use of the marks would likely cause customer confusion, and that Mister Softee’s reputational damages were irreparable as a matter of law. And the court said that the public interest favored injunctive relief, and that Mister Softee was entitled to reasonable attorneys’ fees and costs.
