The Federal Circuit affirmed the decision of the Trademark Trial and Appeal Board affirming an examining attorney’s refusal to register Vetements Group AG’s “Vetements” marks for clothing and online retail store services. The court said that the board’s decision that the marks were generic and merely descriptive without acquired distinctiveness was supported by substantial evidence.
