The district of Massachusetts granted IEP Technologies LLC’s motion for summary judgment on KPM Analytics Inc.’s fraud counterclaim. The court held that KPM failed to demonstrate clear and convincing evidence that IEP made false statements to the USPTO and found no evidence of intent to deceive. And the court granted summary judgment for IEP on KPM’s counterclaim seeking cancellation of the mark due to non-use.
