The district of Maryland denied Adalytics Research LLC’s motion to dismiss Colossus Media LLC’s false advertising claim, finding that Adalytics Research’s blog post constituted commercial speech. The court found that Colossus sufficiently alleged that the post was economically motivated and made with the hope for economic gain, that Colossus plausibly alleged that the statements were false, and that they caused economic injury.
