A federal district court in Florida granted South Seas Villas Condominium Association’s motion to dismiss WS SSIR Owner LLC’s Lanham Act claims on the grounds that the marks were descriptive. The court found that WS SSIR failed to allege sufficient facts to show that “South Seas” was either arbitrary or fanciful. And the court dismissed the duplicative claims and the federal unfair competition claim.
