A federal district court in New York granted Muddy Bites Inc.'s motion to dismiss Evergreen USA LLC’s counterclaims for cancellation of Muddy Bites’ trademark registration, tortious interference, and attempted monopolization, in this action for infringement of mini-cone trade dress and other purported trademarks. The court granted Muddy Bites’ motion to dismiss Evergreen’s tortious interference claims as to any unnamed customers and otherwise denied Muddy Bites’ motion to dismiss.
