A federal district court in California dismissed the operator of HomeOpenly Inc.'s countercomplaint in HomeLight Inc.'s action for false advertising and trademark infringement, claiming that HomeOpenly engages in illegal price fixing, violates other state and federal laws, misleads the public, misuses HomeLight’s logo, and uses a logo that is confusingly similar. According to the court, HomeOpenly’s operator failed to plead counterclaims for violations of the Sherman Act, the Lanham Act, and California’s Unfair Competition Law.
