Chimney Safety Inst. of Am.'s motion for attorneys’ fees and costs, in its action against First Call Chimney Serv. for trademark infringement, was granted by a federal district court in Kentucky. Because First Call failed to answer or otherwise respond to the complaint, the court accepted all well-pleaded factual allegations in the complaint as true — namely, that First Call willfully and blatantly continued to advertise and market its services with Chimney Safety’s certification mark despite repeated notices to cease and desist.
