A federal district court in New York granted Hybrid Promotions LLC’s motion for attorneys’ fees and costs under the Lanham Act on the grounds that it was the prevailing party in The Fashion Exchange LLC’s trademark infringement action, and this was an exceptional case. The court found that The Fashion Exchange unreasonably litigated the case by making improper objections during a court-ordered deposition and failing to preserve financial documents concerning royalties, as well as additional litigation misconduct.
