A federal district court in California granted Kendo Holdings Inc.’s motion for attorneys’ fees in the trademark infringement action brought by Amarte USA Holdings Inc., based on Amarte’s unreasonable conduct during litigation. The court found that Amarte’s repeated attempts to add additional nonviable defendants were unreasonable, unsuccessful, and served to prolong litigation. And the court said that Amarte made factual misrepresentations in its motions and interrogatories, and refused to produce documents requested during discovery.
