A federal district court in Florida denied The BossBabe Societe’s motion to dismiss for lack of personal jurisdiction and improper venue an individual’s action for trademark infringement. The individual, who offers small business owners a variety of services using the registered mark “Boss Babe Club,” brought suit against BossBabe for trademark infringement, false designation, and unfair competition. BossBabe sought to transfer the case to a federal district court in California, but the court determined that Florida’s long-arm statute and due process allows it to exercise personal jurisdiction over BossBabe.
