A federal district court in Indiana denied Badger Daylighting Corp.’s request for an ex parte temporary restraining order and permanent injunction against its former employee in connection with its trade secret misappropriation claim. The court held that Badger wasn’t entitled to ex parte relief because it hadn’t attempted to effectuate service on the former employee, it failed to demonstrate why such notice would be fruitless, and it didn’t present facts to suggest that there was a risk of the former employee modifying or deleting necessary evidence.
