The Federal Circuit affirmed the decision of the District of Utah granting summary judgment in favor of MarketDial Inc. on Applied Predictive Technologies Inc.'s action for trade secret misappropriation and breach of contract. The appeals court affirmed the district court’s conclusion that APT failed to sufficiently identify and define its alleged trade secrets, as well as the dismissal of APT’s breach of contract claim.
