A federal district court denied Secretariat Advisors LLC’s motion to dismiss FTI Consulting Inc.’s trade secret misappropriation claims. The court found that FTI plausibly alleged that Secretariat knew or should have known that former employees had acquired the secrets through improper means. And the court said that to the extent that FTI’s state tort and contract claims relied on the alleged misappropriation of trade secrets, they were preempted by the Georgia Trade Secrets Act.
