A federal district court in California denied Seagate Technologies LLC’s motion to dismiss Access Optical Networks Inc.’s trade secret misappropriation claims and granted its motion to dismiss a breach of contract claim. As a preliminary matter, the court held that none of the claims were time-barred, and the court said that Access Optical’s failure to mark the documents confidential wasn’t grounds to dismiss.
