The Fifth Circuit reversed the decision of a federal district court in Texas dismissing EnvTech Inc.'s Racketeer Influenced and Corrupt Organizations Act claim against the CEO and founder of USA DeBusk LLC, alleging that he directed and conspired with USAD employees to steal EnvTech’s proprietary one-step chemical formula and cleaning process for hydrofluoric acid alkylation units in oil refineries. The appeals court said that EnvTech plausibly alleged that DeBusk engaged in a pattern of trade secret theft in violation of the RICO statute.
