The Eleventh Circuit reversed and remanded a federal district court’s denial of Silikal GmbH’s motion for judgment as a matter of law in AcryliCon USA LLC’s action against Silikal for misappropriation under the Georgia Trade Secrets Act. The Eleventh Circuit found that the evidence showed, at most, that Silikal and a chemical engineer developed the 1061 SW formula trade secret for a flooring resin together in 1987, and that Silikal agreed with the engineer that the formula would be his property and AcryliCon International’s.
