A federal district court in North Carolina denied Microban International Ltd.'s motions for a temporary restraining order, preliminary injunction, and expedited discovery, in its trade secrets misappropriation and breach of contract action against a former employee. The court said that it can’t find by clear evidence that Microban will likely succeed on the merits of its claims at trial, it can’t conclude that irreparable harm to Microban is likely, the balance of equities doesn’t tip in Microban’s favor, and the public interest doesn’t clearly favor entering an injunction.
